\nThe Supreme Court has given a landmark judgment yesterday (June 10) regarding the establishment of ownership of a property. The Supreme Court has categorically stated that a person cannot become the absolute owner of the property just by possessing the title deeds.
\nThe Supreme Court has said that the registration documents are only considered as an additional proof and that many more documents are required for the absolute ownership of the property.
\nWhat is required for absolute ownership? Mere registration documents are not enough to fully use a property or transfer it to someone else. On the contrary, it is the complete possession of all the documents related to that property that will recognize a person as the legal owner of that property.
\nRegistration details: Documents available with the local government office regarding the survey numbers of the property and in whose name the ownership of the particular property is registered.
\nSale details: If the property is being transferred by selling it, details of how much it is being sold (Sale Agreement). Conditions of sale, signatures of the sellers and buyers, signatures of witnesses.
\nLegal expenses: Proof of payment of stamp duty, including registration documents: Registration documents carried out at the registry office.
\nTitle certificate: A certificate of ownership issued by the registry office after all these are completed.
\nNo Objection Certificate (NOC): A certificate of no objection that there is no bank loan or any other issue pending on the specific property.
\nProperty tax documents: Documents for payment of property tax for the specific property.
\nGovernment office certificate: A final certificate submitted to the government office containing details of the ownership of the property.
